Border Adjustments and US Climate Policy: Are they Legal?

Outlines the current status of climate policy bills in the US Congress that include provisions for border tax adjustments, and addresses whether or not such provisions will be legal under current WTO rules. The overall conclusion is that the legality of border tax adjustments will only be established through a WTO dispute settlement panel ruling.
